US Court of Appeals declines to rehear Shivkov vs Artex case

The US Court of Appeals for the Ninth Circuit has denied a petition to rehear the case Shivkov versus Artex.

In September 2020 the court had  decided in favour of Artex Risk Solutions and TSA Holdings, formerly Tribeca Strategic Advisors, in an appeal of the case. The panel at the time affirmed the District of Arizona’s order compelling individual arbitration and dismissed a putative class action alleging violations of the Racketeer Influenced and Corrupt organizations Act and Arizona law.

The full court was advised of the petition for rehearing en banc but this petition was denied on October 28, 2020, meaning the matter must now be settled by individual arbitration.
