
Alabama lifts new captive formation moratorium
Travis Bowden, president of Alabama-approved captive management firm Crossroads Risk Management, has applauded Alabama’s Commissioner of Insurance Mark Fowler’s lifting of Department Bulletins 2025-01 and 2025-05 which placed a moratorium on new formation filings for captive insurance entities and Risk Retention Groups in Alabama.
In a statement Bowden said: “By lifting the 2025 moratorium placed on captive insurance entities and Risk Retention Groups, Commissioner Fowler has once again shown leadership and a commitment to protecting the consumers”, said Crossroads Risk Management President and former Georgia Department of Insurance Captive Insurance Division Supervisor Travis Bowden. “The lifting of this moratorium has occurred at an ideal time as Alabama is continuously explored as a strong option for filers seeking new risk management strategies”, Bowden continued.
Alabama’s Department of Insurance issued a moratorium on new applications for Captive and Risk Retention Group entities in mid-2025. This was due in part to an urgent need for modernising language to help address issues on solvency requirements, filing mechanisms and renewal needs. By the passage of Alabama HB415, these laws were updated to protect the consumers and the marketplace while still working to build on the growing economic presence found in Alabama.
“During my time speaking with members of the Alabama State House of Representatives and State Senate on the necessity of the modernising language of HB415, no one disagreed that Alabama has an impact as a notable and vibrant insurance domicile,” Bowden continued.
“Through the resumed activity found in new captive insurance company and Risk Retention Group formations, Alabama will continue to provide more bespoke and customised options for entities as they expand their operations. That’s why I was honoured to support HB415 and advocate for it every step of the way. Alabama captives are back!”
